Unemployment Disqualifying Factors

Based upon the evidence provided throughout the unemployment case, an adjudicator will make a ruling as to whether an individual is eligible for benefits. One key eligibility requirement is that an individual be totally or partially unemployed due to no fault of their own. There are several main disqualifying factors that can prevent an individual from receiving benefits by failing to meet this test. They include:

Voluntarily Resigned Without Good Cause

If an individual leaves their job voluntarily without a compelling reason, they typically do not qualify for unemployment benefits. Good cause can vary by state but generally includes reasons such as significant changes in the employment contract, unsafe working conditions, or urgent personal matters like a serious family illness.

Discharged for Misconduct from the Most Recent Employer

Unemployment benefits are denied if a person is terminated for misconduct. Misconduct is considered a deliberate or wanton disregard of the employer’s best interests. This can encompass a wide range of behaviors, including violation of company policies, insubordination, theft, or other actions demonstrating a disregard for the employer’s interests. While a discharge may have been considered for a good business cause, only misconduct will deny an individual unemployment benefits.

Refused an Offer of Suitable Work

When an individual turns down a reasonable job offer without good cause, they may be disqualified from receiving unemployment benefits. Suitable work refers to employment that matches the individual’s skills, experience, and location and wage expectations relative to their previous job.
